Scheduled Releases
I met with a client last week who was approached by a liability carrier after their accident and asked to sign a scheduled release. The adjuster for the at fault driver, told my client that they would pay for all the medical bills plus an additional check for small amount for the pain and suffering. The problem is, the insurance company will later decide what they will pay for the medical expenses and there is a cap on it, so these are really bad deals. The at fault insurance carrier tries to get to an accident victim quickly with one of these scheduled releases in hopes that the victim will not seek any type of legal advice. The courts are not clear as to whether they will uphold these releases.
