Parents Sue College for Son's Wrongful Death
In Indiana, it has been reported that a wrongful death lawsuit has been filed against an area college by the parents of an 18-year-old freshman who died from alcohol poisoning after attending a fraternity house party. The parents of Johnny Smith believe the university had a lax attitude toward underage drinking and hazing.
Smith's parents filed their wrongful death claim in Montgomery County Court against Wabash College. It was revealed that Smith was found dead in October 2008 at a Delta Tau Delta house. After tests were performed, it was determined that he had a blood alcohol concentration of .40 percent.
The claim states that the fraternity provided alcohol and beer to Smith and other minors and required Smith to drink shots of hard liquor with the older members. It is also stated that the members of the fraternity did not seek medical care for Smith after he suffered facial injuries while falling down a stairwell. Instead, he was carried up the stairs to sleep in a room.
In their suit, Smith's parents say the all-male liberal arts college shared responsibility for their son's death because it owns the fraternity house. At this time, they are seeking unspecified monetary damages from both the college and the fraternity.
