Nursing Home Abuse is a Growing Concern
Back in December 2009 a nursing home in Brooklyn was found guilty of negligence in the case of a patient who developed multiple bedsores under their care. At that time the patient's family was awarded $4 million for pain and suffering, as well as $15 million for punitive damages for the nursing home negligence in trying to cover it up. This is the first case where a nursing home was hit with punitive charges.
Sadly enough, this is not an isolated case. Nursing home negligence is a growing concern across the country. Institutional elder abuse, as defined by the National Center on Elder Abuse, is "any several forms of maltreatment of an older person by someone who has a special relationship with the elder (a spouse, a sibling, a child, a friend, or a caregiver)". A report released by the University of California, San Francisco in 2009 showed that 44 percent of nursing homes failed to provide a safe environment, while 36 percent had food salutation regulations violations and 26 percent were cited the previous year for poor quality of care.
