About the SSA's No FEAR Act

Nearly a decade ago, Congress established the Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002, which prevents a federal employee or agency from discriminating against an individual or a family applying for Social Security benefits. The act requires these agents and agencies to be held accountable for their action should they be in violation with any antidiscrimination act or whistleblower protection law in to Public Law 107-174. Additionally, this act requires Federal employees to inform you, as an applicant of Social Security disability benefits, to inform you on your rights and the protection available to you. Under this law, discrimination against a person's race, national origin, age, color, religion, sex, disability, political affiliation, parental status, sexual orientation, or marital status is considered unlawful, in accordance with several statutes (5 U.S.C. 2302(b)(1), 29 U.S.C. 206(d), 29 U.S.C. 631, 29 U.S.C. 633a, 29 U.S.C. 791 and 42 U.S.C. 2000e-16).
